About this Case

Plaintiff Joseph Lagasse worked for the Defendant from April to November 2023 as a non-exempt employee.  Plaintiff and the Classes allege that the Defendant has participated in unlawful compensation practices, including the willful failure to pay for all regular and overtime hours worked.  This action was brought forth on behalf of two classes:

The Class is defined as:

All current and former non-exempt employees who worked for Defendant in Washington at any time from May 7, 2021 through the date discovery closes.

The Plaintiff alleges that the Defendant willfully failed to pay for all overtime hours and regular hours worked as well as willfully failed to provide rest and meal breaks, therefore denying to pay the wages for those missed.

EPOA Subclass:

All current and former non-exempt employees who were required to sign Defendant’s Non-Disclosure from October 4, 2021 through the date discovery closes.

The Defendant required its employees to sign a Non-Disclosure Form which stated that they were to keep information about their wages confidential or risk punishment such as termination from their employer.  Based on this information, the Plaintiff alleges that the Defendant violated Washington’s Equal Pay and Opportunities Act (EPOA), which protects employees’ rights to discuss wages freely and promotes a fair working environment.

The Collective:

All current and former non-exempt employees who worked for Defendant as pest control technicians or any other job title used to describe persons performing similar job requirements at any time from May 7, 2021 through the date discovery closes.

The Plaintiff alleges that the Defendant did not account for drive time to job sites in payroll.  Additionally, the Defendant had a policy in which the Collective members were to clock out for an unpaid 30 minute meal break even if they did not receive one.  This policy resulted in termination if the Collective members did not clock out for a meal break.
